Eye Radio lawyers give Hostinger 24 hours to restore website

Lawyers representing Eye Media/Eye Radio have given web-hosting company Hostinger 24 hours to restore and reactivate the broadcaster’s website, which has been offline since September 8.

In a letter dated September 17, the lawyers, Vocares, warned that legal action will be taken if Hostinger fails to restore the website within the given period.

The lawyers say Eye Radio’s website was suspended without notice or the broadcaster’s authorization.

“Our Client is the lawful proprietor and subscriber of a hosting account with Hostinger,” the lawyers said, adding that the company was expected to provide “continuous, uninterrupted and secure hosting services” for the website.

The lawyers say the suspension is linked to a court case in Kenya. However, they argue that Eye Media/Eye Radio is not a party to that case.

They say the High Court of Kenya at Kisumu confirmed during a hearing on September 17 that there are only four named defendants in the case and that Eye Media/Eye Radio is not among them.

“Our Client has neither been sued, served, joined, nor cited in the said proceedings,” the lawyers said.

The lawyers are therefore demanding the “immediate, unconditional and unreserved restoration” of the Eye Radio website.

They have also asked Hostinger to provide written confirmation that the website has been restored within 24 hours of receiving the letter.

The lawyers further want Hostinger to undertake not to suspend or deactivate the website again without a lawful court order or an authorized instruction from Eye Radio.

They warned that failure to comply would result in legal proceedings against the company “without further notice.”

The lawyers also say the continued suspension has disrupted Eye Radio’s ability to publish news and information to the public.

Eye Radio’s website has remained inaccessible since September 8. Hostinger has not yet publicly responded to the demands contained in the letter.
